THE FOLLOWING DESCRIBES THE TERMS ON WHICH PERKOPOLIS CRUISES BYITS, WITH TRAVEL FULFILLMENT BY INNOVATIVE TRAVEL SOLUTIONS, LLC ANDDISCOUNT CRUISE CITY, INC D.B.A. CROWN TRAVEL AND CRUISES OFFERSYOU ACCESS TO OUR SERVICES.
Welcome to the user agreement (the “Agreement” or “User Agreement”) for Perkopolis Cruises by ITS, with travel fulfillment by Innovative Travel Solutions LLC and Discount Cruise City Inc D.B.A. Crown Travel and Cruises (“The Company”). This Agreement describes the terms and conditions applicable to your use of our services available under the domain and sub-domains of PerkopolisCruise.com. If you do not agree to be bound by the terms and conditions of this Agreement, do not use or access our services.
You must read, agree with and accept all of the terms and conditions contained in this User Agreement and the Privacy Policy, which include those terms and conditions expressly set out below and those incorporated by reference, before you use this site. The Company may amend this Agreement at any time by posting the amended terms on the Site. Except as stated below, all amended terms shall be effective immediately once posted on the Site. This Agreement is effective upon acceptance in registration for new users and is automatically readopted with every use of the site.
Eligibility.
Our services are available only to, and may only be used by individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to children (persons under the age of 18). If you are under the age of 18, you cannot use this service. If you do not qualify, please do not use our Site. If you are registering as a business entity, (i.e. Travel Agency, Wholesaler, GroupCoordinator, Hotel, or other Travel Services Vendor.) you represent that you have the authority to bind the entity to this Agreement. Business entities using this service to receive rate quotes without ever contacting a vendor online are subject to account suspension or termination.
PerkopolisCruise.com is a Venue.
PerkopolisCruise.com by ITS is only involved in the actual transaction between travel buyers and travel sellers/vendors as an intermediary. As a result, Perkopolis Cruise has no control over the quality or safety of the actual travel products being purchased on this site and is not liable for the financial default or any harm that may come to the buyer(s) of travel related services on this site.
RESPONSIBILITY AND LIMITATION OF LIABILITY
Perkopolis Cruises by ITS arrange the services described on this site, including without limitation cruises that are provided by Cruise Lines, lodging that is provided by Hoteliers, which are independent contractors and not the agents, employees, partners, or joint ventures of The Company. Perkopolis Cruises by ITS, with travel fulfillment by Innovative Travel Solutions Inc and Discount Cruise City Inc D.B.A. Crown Travel andCruises provide a negotiation venue for such group travel services merely for the convenience of companies that furnish such services. Such contractual negotiation services are subject to all terms and conditions of the respective suppliers (some of which may limit or exclude the supplier’s liability). Perkopolis Cruises by ITS, with travel fulfillment by Innovative Travel Solutions Inc and Discount Cruise City Inc D.B.A. Crown Travel and Cruises shall not be responsible for any loss of or damage to property or death or injury to a person, resulting from any act or omission of any supplier providing any product or service or any other person or entity, or caused by strike, war, weather, act of god, quarantine, sickness, government restriction or regulation, or any other cause beyond The Company’s control. Traveler expressly waives all rights he or she may have against The Company in connection with the foregoing. Under no circumstances is The Company to be constructed as carriers under contract for safe carriage of the traveler or his or her baggage and belongings. It is understood and agreed that The Company shall at all times act in the capacity of any independent contractor and not as an employee, partner, agent, joint venture, or principal of any travel agent, cruise line, group coordinator or hotel.
Neither The Company or cooperating organizations shall be responsible for any cancellations or for acts of any other service providers, diversions or substitution of cruise lines, cruise ships, itinerary changes, hotels, or any other persons providing any of the services and accommodations to passengers. Nor shall they be liable for any loss or damage to baggage or property, or for injury, illness or death, or for any damages or claims whatsoever arising from any act, error, omission, default or negligence of any person not a direct employee of The Company. The carriers, cruise lines, hotels and other suppliers who provide services are independent contractors and are not agents, employees or servants of Perkopolis Cruises by ITS, with travel fulfillment by Innovative Travel Solutions Inc and Discount Cruise City Inc D.B.A. Crown Travel and Cruises.
Perkopolis Cruises by ITS, with travel fulfillment by Innovative Travel Solutions LLC and Discount Cruise City Inc D.B.A. Crown Travel and Cruises are not responsible for any criminal conduct by third parties. In no event shall Perkopolis Cruises by ITS, with travel fulfillment by Innovative Travel Solutions LLC and Discount Cruise City Inc D.B.A. Crown Travel and Cruises have any liability to any person or entity. Perkopolis Cruises by ITS, with travel fulfillment by Innovative Travel Solutions LLC and Discount Cruise City Inc D.B.A. Crown Travel and Cruises make no warranties, guarantees or representation of any kind or implied, arising by law or otherwise, including without limitation any implied warranty of merchantability or fitness for a particular purpose, or any implied warranty arising from course of performance, course of dealing, or usage of trade.
The discount/rebate amount or other special offers (i.e. Excursion Credit, Onboard Credit, Cash Back or any other discounts), collectively referred to as “Promotions” in your quotes is based on the full/total amount of rooms requested at the specific price of your cruise or travel arrangement, before taxes, port charges, and other fees (base commissionable fare). The Promotions will only be honored for actualized/consumed cruise rooms and documented rooms. Promotions may fluctuate based on actualized hotel room nights booked or documentation in the form of receipts or confirmed group list. Travel Agents are not eligible for Promotions and are not able to book for 3rd parties on PerkopolisCruise.com.
Every effort is made to ensure website accuracy at the time of publication; however, The Company cannot be held responsible for printing or typographical errors, product changes and content changes on websites.
PHYSICAL DISABILITIES:
Cruise Lines and Hotels may not have the appropriate special services and equipment to accommodate all individuals with disabilities or special needs. Those requiring guaranteed accommodations for those with disabilities or special needs are advised to communicate directly with the hotel.
The website, including these Terms and Conditions, represents the entire agreement between the cruise line, travel agent, Group Coordinators, Wholesalers, the Individual Booking Party, the Hotels, any other Travel Services Vendors and Perkopolis Cruises by ITS, with travel fulfillment by Innovative Travel Solutions LLC and Discount Cruise City Inc D.B.A. Crown Travel and Cruises.
Any party using The Company’s system in a fraudulent manner will be subject to a $10,000 USD fine. This fraud includes but is not limited to false booking request, bait and switch pricing techniques, or false user information of any kind. Violators will be prosecuted to full extent of the law.
Credit Card Chargebacks
You, the User, have the ability to dispute charges with credit card companies (“chargebacks”). If you have a question about a charge on your credit card statement, we encourage you to contact us, The Company, prior to disputing a charge with your credit card company to discuss any questions or concerns about our charges with us. The Company will work with you in resolving your concerns. The Company retains the right to dispute any chargeback that it believes is improper, as described more fully below. The Company also retains the right to cancel any travel reservation in the event of a chargeback related to that reservation.
By using our service to make a reservation with a Cruise Line or any other travel Supplier or vendor, you accept and agree to the relevant cancellation policy of that Supplier. In all cases, the cancellation policy of each reservation is made available on our website or on the website of the Cruise Line or other travel supplier. Please note that certain rates or special offers are not eligible for cancellation or change, which means all payments are subject to non-refundable policy from the time of booking. The Company deems the following chargeback scenarios as improper and retains the right to investigate and rebut any such chargeback claims and to recover costs of such chargeback claims from You, the User:
COVID-19 NOTICE FOR ALL TRAVELERS:
– Prior to booking, please consult all applicable U.S. and/or Canadian Centers for Disease Control as well as travel advisories, warnings, or recommendations relating to the vacation you booked by any government agency in any country you are visiting, available at http://www.cdc.gov/travel/notices or the travel advisory website of any country you are visiting. It is also extremely important that you check COVID-19 restrictions, warnings and policies issued by every country you are visiting (including airline connections in foreign countries, every airline, cruise line, hotel, tour operator, train or bus operator, and those of any other public carrier you plan to utilize during your vacation). If a certain threshold level of COVID-19 is detected by any carrier during your travels, the remainder of your travel itinerary may be immediately terminated, and all subsequent travel, including your return home, may be restricted or delayed. For cruises and guests worldwide: Health and safety protocols, guest conduct rules, as well as regional travel restrictions and clearance to visit ports of call, are subject to change without notice based on ongoing evaluation, public health standards, and government requirements. Onboard and destination experiences, features, itineraries and guest conduct rules vary by cruise line, ship and destination, tour operator, hotel, etc. and are subject to change without notice.
- It is the sole responsibility of the customer/passenger to verify all of these requirements prior to purchasing travel and to adhere to these guidelines during travel. Perkopolis Cruise and their affiliates and representative agents are not responsible for, and the customer agrees to further indemnify Perkopolis Cruise and their affiliates and representative agents from any and all losses related to COVID-19 travel restrictions, vendor cancellations, closures, financial default, bankruptcy, delays and illness prior to, during and after the planned dates of travel arranged by Perkopolis Cruise and/or any of their travel vendors and suppliers
– Travel insurance is available and STRONGLY advised. Cancellation penalties apply to ALL travel arrangements. If you have any questions about travel insurance, please contact your booking agent.
– Federal law forbids the carriage of certain hazardous materials, such as aerosols, fireworks, and flammable liquids, aboard the aircraft. If you do not understand these restrictions, contact your airline or go to http://www.faa.gov/about/initiatives/hazmat_safety.
– All travelers must provide legal first, middle and last names as they appear on government issued proof of citizenship and photo ID at time of booking. Please check all passenger information prior to confirming your reservations and on subsequent travel confirmations for accuracy. Any expenses incurred to correct documents after booking will be at customer’s expense.

Required Travel Documents:
– It is the sole responsibility of the passenger to be in possession of proper documentation required to travel.
– U.S. & Canadian Citizens: Government Issued Photo ID (domestic travel) or passport (international travel) is required for flights.
URGENT
ALL U.S. and Canadian citizens are required to present a U.S. PASSPORT upon leaving and returning to your country of origin and citizenship. Some destinations require that the passport be valid for 6 months after the end of the trip.
If you need forms or information on how to renew, or obtain a new U.S. or Canadian Passport, please visit your country’s passport website.
ALL U.S. and Canadian citizens and legal residents/green card holders traveling must verify that they meet all travel requirements to visit all countries, including connections made outside of your country prior to confirming and paying for their travel reservation(s). Perkopolis Cruise is not responsible for denied boarding or any financial loss associated with refusal or cancellation of travel arrangements due to the lack of proper documentation.
– All U.S. and Canadian Citizens: Must check with consulates for every country you are visiting for required documents and/or visas.
Restrictions and Cancellation:
– Restrictions and Cancellation Penalties Apply per the travel supplier/vendor/carrier’s publicly stated restrictions, cancellation policies and penalties as stated on their respective websites and as agreed to during the booking process. Any penalties and fees, including but not limited to fees associated with credit card processing and other bank fees, will be enforced by Perkopolis Cruise and the user agrees to pay Perkopolis Cruise fees that may be assessed to cover expenses incurred by Perkopolis Cruise on the user’s behalf.
Notice:
– COMPLETION OF A TRAVEL RESERVATION REPRESENTS AN IMMEDIATE TRANSFER OF FUNDS FROM OUR AGENCY TO THE PARTICIPATING CARRIERS UPON ISSUANCE OF TICKETS ON YOUR BEHALF. YOU ARE RESPONSIBLE FOR PAYMENT OF ALL FEES TO OUR AGENCY. YOUR PROMPT REMITTANCE IS REQUIRED
Dishonored Checks and credit card chargebacks:
– A $50.00 Fee will be charged for ALL returned checks.
– A $50.00 Fee will be charged for all incoming/outgoing Bank Wires
– A $95.00 Fee will be charged for ALL credit card chargebacks and/or credit card disputes. Furthermore, the traveler agrees to pay all amounts charged to their credit card in accordance with the credit card’s issuing bank’s cardholder agreement. The traveler hereby authorizes the fees they are being charged for the travel they are purchasing and agree not to dispute or chargeback any of the fees charged by Perkopolis Cruise or any of Perkopolis Cruise travel supplier or wholesaler acting on their behalf and/or providing travel or travel related services to the traveler.
Currency:
– All dollar amounts on this invoice are stated in United States Dollars unless otherwise noted.
Tax:
– Tax amounts stated on this invoice include government fees and taxes, and NCF fees. Resort fees, if any, will be collected directly by the hotel/resort upon check-in. Additional mandatory fees and optional purchases (I.e. optional excursions, food, drinks, optional transfers, gratuities.) are not included and are the responsibility of the traveler. Taxes, fees, and fuel surcharges are subject to change.
Liability Limiting Terms and Conditions:
Perkopolis Cruise and their affiliates and affiliated agents and travel suppliers, hereinafter referred to as the Agency, issued for all travel purchases in the sole capacity of agent for the owners, wholesalers and/or contractors, whose names appear on these travel arrangements/documents and who are hereinafter referred to as Suppliers, of the transportation and/or other services specified. As such the sole financial liability of the Agency is limited to the amount of commission it receives from said Suppliers in arranging said transportation and/or services on behalf of the named user/traveler/client. If any Supplier shall cancel the specified transportation and/or other services for any reason other than financial insolvency, the Agency is bound to refund all deposits received on behalf of the named Client upon advice and/or refund from the said Supplier.
This invoice is issued subject to any and all terms and conditions under which any transportation or other service is provided by the Suppliers. The Agency shall not become liable for any personal injury, property damage, accident, delay, inconvenience change in itinerary or accommodations or other irregularity which may occur due to (1) wrongful, negligent or arbitrary acts or omissions on the part of the Suppliers, their employees or others not under the direct control of the Agency (2) defects or failures of any conveyance, equipment or instrumentality under the control of the Suppliers and (3) but not limited to Acts of God, fire, acts of governments or other authorities, wars, civil disturbances, riots, strikes, thefts, pilferage, epidemics, pandemics, quarantines or dangers incident to the sea, land and air.
The user/traveler/client, by engaging the Agency and making deposit and/or full payment for the travel arrangements specified, acknowledges the position of the Agency as stipulated by the foregoing, agrees to hold the Agency blameless in making the arrangements on his behalf, provided same shall be made through generally acceptable Suppliers at the time of engagement, and further agrees that restitution or damages, if any or claimed, shall be sought directly from the Suppliers. The user/traveler/client further agrees to abide by the terms and conditions of the Suppliers of the services to be performed. In addition, the user/traveler/client acknowledges that insurance was available that would provide compensation for lost or damaged luggage, trip cancellation, medical expenses and Supplier bankruptcy while planning or on the trip.
Neither the Company, The Agency, or its agents, are responsible to provide proof of citizenship, visas or vaccination record for any passengers. Any complications, delays or expenses incurred due to lack of proper documentation required for travel is the sole responsibility of the user/traveler/client. The Agency and its agents will not assume any responsibility or expense for lack of documents required to travel.
